General Terms and Conditions for STAMPF RECORDS

1. Scope
These General Terms and Conditions (ToS) apply to all contracts, services, and business relationships between Stampf Records (hereinafter referred to as the “Label”) and artists, customers, and business partners who use our website (www.stampfrecords.com) or enter into contracts with us.
2. Services of this Label
2.1. The Label provides services in the areas of music production, distribution, promotion, and licensing.
2.2. The specific services are agreed upon individually by contract.
2.3. The Label reserves the right to modify or discontinue content or services at any time.
3. Conclusion of Contract
3.1. A contract is concluded through a written agreement or an electronic confirmation (e.g., via email).
3.2. The Label reserves the right to reject contracts without stating reasons.
4. Rights and Obligations of Artists
4.1. The artist guarantees that they hold the necessary rights to their works and that these are free from third-party rights.
4.2. The artist grants the Label the necessary usage rights to the works for the agreed contract period for distribution, marketing, and promotion.
4.3. The artist undertakes to inform the Label of any existing contracts or third-party rights.
5. Compensation and Accounting
5.1. Artist compensation is provided either through advances, revenue sharing, or fixed licensing fees, depending on the agreement.
5.2. Statements are issued within the contractually agreed periods and made available to the artist electronically.
5.3. The Label reserves the right to make deductions for administrative and distribution costs in accordance with the contractual terms.
6. Licensing and Use of Music
6.1. The Label has the right to distribute the musical works on digital platforms, physical media, and other formats.
6.2. Any use of the music by third parties requires the approval of the Label and, where applicable, the artist.
6.3. The Label is entitled to use the works for promotional purposes unless otherwise agreed in the contract.
7. Liability
7.1. The Label is not liable for lost revenue, indirect damages, or rights infringements by third parties.
7.2. The artist shall indemnify the Label against third-party claims arising from copyright infringements or other legal violations.
8. Contract Term and Termination
8.1. The contract term is defined in the individual agreement.
8.2. Ordinary termination is possible with one month’s notice unless otherwise agreed.
8.3. Termination without notice is possible in the event of serious breaches of contract or violations of applicable law.
9. Data Protection
9.1. The Label processes personal data in accordance with applicable data protection regulations (GDPR).
9.2. Further information on data processing can be found in the privacy policy on the website.
10. Final Provisions
10.1. The laws of the Federal Republic of Germany shall apply.
10.2. The place of jurisdiction is Landau (Palatinate), where legally permissible.
10.3. Should any provision of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
